Symptom
- The CAN-SPAM Act of 2003 signed into law by President George W. Bush, establishes the United States' first national standard for the sending of commercial e-mail and requires the Federal Trade Commission (FTC) to enforce its provisions. The acronym CAN-SPAM derives from the bill's full name: Controlling the Assault of Non-Solicited Pornography And Marketing Act of 2003.
-
CAN-SPAM defines a "commercial electronic mail message" as "any electronic mail message the primary purpose of which is the commercial advertisement or promotion of a commercial product or service.” It specifically exempts "transactional or relationship messages."
-
The Talent Community Job Agent emails, as well as the emails sent from the Talent
Community Marketing module, are exempt from this law because they are of a
“relationship” nature. There is nothing contained in the email messages sent to Talent
Community Members that are a commercial advertisement or promotion of a commercial
product or service.
-
In 2004, the FTC issued final rules clarifying the phrase "primary purpose" in the law. While Jobs2web believes emails from the Talent Community are except from the previsions of this law, there are some best practices to follow to insure adherence.
- Be clear with your subject line and do not use deceptive subject lines
- The primary message for the email should be placed towards the top of the body
- Use the available email tokens to represent your company and URL
- Use the available email tokens to insert the URL for the user to unsubscribe
