E-Verify:  What does it mean "DHS No Show"?

 

When there is an E-Verify activity where the DHS returned a TNC Tentative non-confirmation the new hire must go to the DHS to resolve whatever the issue is.

  • The employee did not visit a DHS field office within federal government workdays
  • A “DHS No Show” indicates that the employee did not contact DHS within the required eight federal government workdays.
  • A “DHS No Show” case result is considered a final non-confirmation. A final non-confirmation means that the case must be closed in E-Verify.
  • The employer may terminate employment based on a case result of “DHS No Show: with no civil or criminal liability as noted in Article II, Section C – Responsibilities of the Employer (#6) in the MOU.

See panel below.  Please consider close a No Show case as per the panel.  If the new hire did not go to the DHS to fix the TNC, the new hire has voluntarily quit work.  This person is NOT eligibile to work in the United States.
