For the agency - there is a setting in provisioning that defines the candidate ownership:

Ownership for Requisition -  If ownership is set at the requisition level, the same candidate can be submitted to distinct requisitions by different agencies. This ownership will remain indefinitely, with no time limit.
Additional details:
Within 24 hours of the candidate's creation, agency users who belong to that agency will be able to submit this new candidate to job requisitions by using the "Submit Existing Candidate" button. After 24 hours, it will still be possible to submit the same candidate to other requisitions, however, only the "Submit New Candidate" option will allow this (note: The message "candidate already exists" will appear, but the process can be completed).

Ownership for Duration -  If ownership is defined as duration, the user can define a time period (for example, 180 days in screenshot below). Only the agency that owns a candidate can submit that candidate to requisitions for that time period. 

In the example above, "Candidate ownership" is set to 180 days, meaning the agency will own the candidate for that duration.
After 180 days, the candidate becomes self-owned for a period defined in the "Candidate self-ownership" field.
During the self-ownership period, no agency will be able to submit the candidate to any requisition.
Only after the "Candidate self-ownership" period will it be possible for agencies to submit the candidate again.

If a candidate has already been forwarded/applied to a Requisition from either the career site or agency you will not be able to add them to the same requisition.
