3703010 - PY-BE: Extension of the relapse period for guaranteed wage as of January 1, 2026

Symptom

On December 30, 2025 new legislation was published strengthening the return-to-work policy in cases of incapacity for work.

These measures have taken effect as of January 1, 2026. As part of these measures the relapse period for the purposes of guaranteed wage have been extended from 2 to 8 week. However, the relapse periods with regard to the assimilation of holiday rights or the invalidity benefits remain at 2 weeks. Furthermore, the neutralization of the guaranteed wage during a period of RPI (Recognized partial illness) is no longer limited to the first 20 weeks of RPI. As of Januari 1, 2026 guaranteed wage will not be paid during the complete period of RPI.
