The behavior is by desing 

Data Actions do not check data locks when making changes to a private version or to the public edit. The validation of the data changes against data lock violations takes place only when the changes are published, for example, when the Data Action is configured to also publish the changes.

Data lock validation before publishing is already supported for manual data entry in stories. However, extending this behavior to Data Actions, so that they also respect data locks before publishing changes made to a private version or public edit, is currently on the product roadmap
